Intelligence UK Investigations (“IUKI“) is lobbying Parliamentarians to support enactment of a new criminal offence of ‘corrupt and or improper exercise of judicial powers and privileges‘ to ensure that members of the judiciary to act in a way contrary to the statutory oath of office, part of the English written constitution at Section 4 of the Promissory Oaths Act 1868, are made criminally liable.

Section 26 of the Criminal Justice & Courts Act 2015

Section 26 of the Criminal Justice and Courts Act 2015 creates a statutory offense for the corrupt or other improper exercise of police powers and privileges. This offense complements the existing common law offense of misconduct in public office. It specifically targets police constables who improperly exercise their powers and privileges, knowing or having reason to know that the exercise is improper, and with the intent to achieve a benefit for themselves or a benefit or detriment for another person. 

The offence proposed by IUKI will ensure that all judicial officers in the United Kingdom uphold the highest standards in exercise of their powers and privileges, and whereas after IUKI’s 6-year investigation, it concludes that the judiciary of England and Wales is largely unregulated and misconduct must be regulated to ensure that anyone abusing their positions face justice, in the public interest.

The statutory judicial oath of office is a crucial part of England’s written constitution, and yet, it is entirely unregulated and is indeed self-regulating, as in other judges regulate themselves, which, in our view is in many respects, incompatible with the natural justice principle of nemo judex in causa sua. No one can be judge of their own cause.

England’s judiciary is self-regulating, largely, however, there is overarching tendency to conceal wrongdoing by other judges, rather than to address what has become a massive risk to democracy.

The people of England and Wales have the inalienable right of access to a properly constituted judiciary and a judge who does acts in breach of his oath must know he can be made criminally liable.
