In the Craig v Kanssen judgment it was re-affirmed that an individual affected by a court order that is a nullity (meaning void from the beginning due to a fundamental lack of jurisdiction or procedural fairness) is entitled to have that order set aside ex debito justitiae (as a matter of right or justice).
